TRESSPASSERS ARRESTED AT CIRCLE K

Please see the statement below regarding the arrest of Samuel and Adam Williams at Circle K this weekend. Affidavits have been attached and video, which has been requested by several media outlets, is below.

At 10:05 a.m. on Saturday June 16, DeLand PD was dispatched to the Circle K for the report of a disturbance inside the business. Employees inside reported that at least one subject had been serving himself sodas and re-filling his cup at the soda fountain dispensary and was not paying for them. At one point an employee confronted him and asked him to leave the business. One of the individuals requested to pay for the drinks and the employee refused payment instead asking him to leave the property and not return. Employees inside reported the two became loud and disruptive and were asked to leave.

Upon arrival the employees requested DeLand Police officers remove the one subject from the property and trespass him. Florida law requires that police honor all legitimate trespass requests.

DPD officers made contact with the subject on the property and attempted to identify him, which is a legal requirement to trespass a person in the state of Florida. All attempts to verify the name he provided them failed and officers provided him the opportunity to use a rapid fingerprint check so they could identify him. All that was required by law was a correct identification and police could then issue the subject his trespass notice and he would be free to leave. The subject refused to submit to the rapid fingerprint identification required to identify him and when he refused he was placed under arrest. When officers attempted to arrest him he resisted their lawful efforts to do so and he was subsequently arrested and charged with Resisting Arrest without Violence.

Officers later learned that he had lied to them and provided them with a false name and he was also subsequently charged with providing false identification to law enforcement.B
